No. Liberty Home Guard doesn’t require a home inspection or any maintenance records to purchase a home warranty plan. Also, we will not refuse coverage due to the age of your home’s systems and appliances.

Can I cancel at any time?

Yes, you can cancel at any time. If your cancellation occurs within the first 30 days of your coverage, we’ll refund your contract fees minus the cost of claims paid, and we will charge a small administrative overhead fee. If you cancel after the 30th day, you’ll receive a prorated refund of your contract fees for the rest of the contract term minus the cost of claims paid, and we will charge a small administrative overhead fee. To cancel your policy with Liberty Home Guard, please log in to your online customer portal and select the ‘Policy Details’ tab. There you will find a link titled ‘Cancel Coverage’. 1. INTRODUCTION

Liberty Home Guard LLC and its affiliates (“LHG,” “we,” or “us”) respect your privacy. This Privacy Policy governs your use of libertyhomeguard.com (the “Site”) and our services. By accessing our Site, submitting a quote request, or using our services, you agree to this Policy. This Privacy Policy is incorporated into and subject to the Liberty Home Guard Terms of Use (available at https://www.libertyhomeguard.com/terms-of-use/). Your use of the Site and our services is governed by the Terms of Use, including all limitations of liability and dispute resolution provisions set forth therein.

2. INFORMATION WE COLLECT

We collect information to provide services, process claims, and manage vendor relationships.

Personal Information: Name, address, phone number, email, payment details (encrypted), and account credentials.
Technical Data: IP address, browser type, device ID, and geolocation.
Session Replay & Usage Data (CIPA Notice): We use third-party tools (such as Hotjar, FullStory, or Google Analytics) that may employ software code to record your interactions with the Site, including mouse movements, keystrokes, scrolling, and clicking. By using the Site, you expressly consent to this monitoring and recording for quality control and fraud prevention purposes.
Biometric Data: For technicians and vendors, we collect facial geometry data for identity verification (see Section 5).
Data Retention. We retain Personal Information only as long as necessary to fulfill the purposes outlined in this Policy, or as required by law (e.g., tax, legal, accounting). * Biometric Data: Retained max 3 years.

3. COMMUNICATIONS AND CONSENT TO CONTACT (TCPA & CAN-SPAM)

IMPORTANT: PLEASE READ CAREFULLY. By submitting your contact information to LHG (via web form, phone, or email), you expressly request and consent to receive communications from LHG and its partners, agents, and service providers.

Prior Express Written Consent: You agree that LHG may contact you via telephone calls, text messages (SMS/MMS), emails, and push notifications.
Automated Technology: You specifically consent to receive communications generated by an automatic telephone dialing system (ATDS), pre-recorded messages, artificial voice, and AI-generated voice technology.
Do Not Call Lists: You waive any rights under federal or state "Do Not Call" registries.
Condition of Purchase: Consent to receive automated marketing calls/texts is not a condition of purchasing any goods or services.
Recording: You agree that all calls to and from LHG may be monitored and recorded.

4. HOW WE USE AND SHARE INFORMATION

We do not sell your Personal Information for monetary consideration. However, we may share information as follows:

Service Providers: With contractors, claims adjusters, and repair professionals to fulfill your service requests.
Marketing Partners (CPRA Notice): To provide you with relevant offers. Under California law (CPRA) and other state laws, sharing data for cross-context behavioral advertising may be considered "selling" or "sharing." You may opt-out of this (see Section 6).
Legal Compliance: When required by law, subpoena, or to protect LHG’s rights and safety.

5. BIOMETRIC INFORMATION (TECHNICIANS & VENDORS)

Technicians agree to the collection of biometric identifiers (facial geometry) for identity verification.

Retention: Biometric data is permanently destroyed no later than the earlier of: (i) three (3) years after the last interaction; or (ii) 30 days after a valid deletion request, unless a longer period is required by law.
Incidental Capture: If you are a non-technician (e.g., a homeowner) and your image is incidentally captured during a technician's verification process, you release LHG from liability regarding such incidental collection.

6. YOUR PRIVACY RIGHTS & OPT-OUTS

6.1. Marketing Opt-Out.

Processing Time: We honor opt-out requests within a reasonable time, not to exceed ten (10) business days for calls/texts, or as required by applicable law.

7. DATA SECURITY

We use industry-standard encryption and safeguards. However, you acknowledge that no transmission over the Internet is 100% secure. You are responsible for keeping your account credentials confidential.

8. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER

8.1. Mandatory Arbitration. Any dispute relating to this Policy or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in New York, NY.

8.2. Class Action Waiver. You waive any right to participate in a class action or representative proceeding.

8.3. Mass Arbitration Protocol. If 25 or more similar demands for arbitration are filed against LHG by the same or coordinated counsel ("Mass Filing"), they shall be resolved in staged batches of 50. Arbitrator filing fees for non-active batches shall be suspended until the batch is active. You agree to this process to ensure efficient resolution and minimize costs.

8.4. Jury Waiver. You strictly waive your right to a trial by jury.

9. THIRD-PARTY LINKS

Our Site may contain links to third-party websites (e.g., financing partners). We are not responsible for their privacy practices.

10. CHANGES TO THIS POLICY

We may update this Policy at any time. Your continued use of the Site after the Effective Date constitutes acceptance of the revised terms.

1. ACCEPTANCE OF THE TERMS OF USE:

These Terms of Use (the “Terms”) constitute a legally binding agreement between you (“User,” “You,” or “Visitor”) and Liberty Home Guard LLC and its affiliates (collectively, “LHG,” “we,” “us,” or “our”). By accessing, browsing, or using the website located at libertyhomeguard.com (the “Site”), accessing LHG web portals, requesting a quote, or purchasing LHG products and services (“Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY EXIT THE SITE AND DISCONTINUE ALL USE OF LHG SERVICES.

LHG reserves the right to modify these Terms at any time without prior notice. Changes are effective immediately upon posting. Your continued use of the Site after any modification constitutes your acceptance of the revised Terms.

2. INCORPORATION OF PRIVACY POLICY

Your use of the Site is also governed by our Master Privacy Policy, which is hereby strictly incorporated by reference into these Terms. You acknowledge that you have read the Privacy Policy (available at https://www.libertyhomeguard.com/privacy-policy/) and consent to the data practices described therein. A violation of the Privacy Policy by you shall be deemed a material breach of these Terms. Any dispute regarding privacy, data protection, or communications (including TCPA/SMS claims) is subject to the Arbitration and Limitation of Liability provisions in these Terms.

3. CONSENT TO SITE MONITORING & SESSION REPLAY (CIPA NOTICE)

IMPORTANT LEGAL NOTICE: To ensure Site functionality, prevent fraud, and analyze user behavior to improve our services, LHG uses third-party analytics and "session replay" software (such as Hotjar, FullStory, Google Analytics, and similar tools). By accessing the Site, you explicitly and affirmatively consent to:

(A) The real-time monitoring, interception, recording, and storage of your interactions with the Site by LHG and its third-party vendors; and
(B) The capture of your mouse movements, clicks, keystrokes, text input (including form data), scrolling activity, and page navigation. You acknowledge that this collection is essential for the operation of the Site and constitutes your "prior express written consent" to the monitoring, recording, and transcription of your site activity under the California Invasion of Privacy Act (CIPA), the Pennsylvania Wiretapping and Electronic Surveillance Control Act, and other applicable state and federal wiretapping laws.

4. INTELLECTUAL PROPERTY RIGHTS

4.1. Content Ownership. The entire content of this Site—including but not limited to graphics, logos, text, images, code, software, audio, video, and data compilations (collectively, "Content")—is the exclusive property of LHG, its affiliates, or its content suppliers and is protected by U.S. and international copyright, trademark, patent, and trade dress laws.

4.2. Trademarks. "Liberty Home Guard," the Home Guard icon, libertyhomeguard.com, and all related logos and service names are registered trademarks or trade dress of LHG. You may not use these marks in connection with any product or service that is not LHG’s, in any manner likely to cause confusion, or in any manner that disparages LHG.

4.3. Limited License. LHG grants you a limited, revocable, non-exclusive, non-transferable license to access the Site solely for personal, non-commercial use. Any unauthorized use, reproduction, modification, distribution, scraping, or transmission of the Content is strictly prohibited and results in immediate revocation of this license.

5. PROHIBITED CONDUCT & USE RESTRICTIONS

You agree NOT to use the Site for any unlawful purpose. Specifically, the following activities are strictly prohibited and constitute a material breach of these Terms:

Scraping & AI Training: Using any robot, spider, scraper, offline reader, deep-link, or other automated data gathering tool to access the Site, extract data, or train artificial intelligence (AI) or machine learning models without LHG’s express written permission.
Security Breaches: Attempting to probe, scan, or test the vulnerability of the Site or our network; breaching security or authentication measures ("hacking" or "password mining").
Interference: Taking any action that imposes an unreasonable or disproportionately large load on our infrastructure (DDoS) or interferes with the proper working of the Site.
Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or derive the source code of any software comprising the Site.

6. TERMINATION

LHG reserves the right, in its sole discretion, to terminate or suspend your license to use the Site and to block your future access to the Site at any time, for any reason, without notice. Reasons for termination include, but are not limited to, your breach of these Terms, requests by law enforcement, or technical issues.

7. DISCLAIMER OF WARRANTIES

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, LHG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LHG DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. LIMITATION OF LIABILITY (HARD CAP)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

NO CONSEQUENTIAL DAMAGES: IN NO EVENT SHALL LHG, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, REVENUE, OR DATA) ARISING FROM YOUR USE OF THE SITE OR SERVICES.
MONETARY CAP: LHG’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL BE STRICTLY LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO LHG IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
BASIS OF THE BARGAIN: YOU ACKNOWLEDGE THAT LHG HAS SET ITS PRICES AND PROVIDED ACCESS TO THE SITE IN RELIANCE UPON THESE LIMITATIONS OF LIABILITY, WHICH FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LHG and its affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (i) your use of the Site or LHG Services; (ii) your violation of these Terms; or (iii) your violation of any third-party right, including without limitation any intellectual property or privacy right.

10. DISPUTE RESOLUTION: ARBITRATION & CLASS WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT WAIVES YOUR RIGHT TO A JURY TRIAL.

10.1. Mandatory Informal Dispute Resolution. Before filing any arbitration or claim, you agree to first send a detailed Notice of Dispute to compliance@libertyhomeguard.com. You and LHG agree to attempt to resolve the dispute in good faith for a period of sixty (60) days. You may not initiate arbitration until this period has expired.

10.2. Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Services (including statutory claims such as TCPA, CIPA, or BIPA) shall be determined by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

10.3. Governing Law & Venue. These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles. The seat of arbitration shall be Kings County (Brooklyn), New York, or remotely if mutually agreed.

10.4. Class Action Waiver. YOU AND LHG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

10.5. Mass Arbitration Protocol ("Batching"). To prevent the abuse of the arbitration process, if 25 or more similar demands for arbitration are filed against LHG by the same or coordinated counsel ("Mass Filing"), the following protocol applies:

Staged Batches: Claims shall be organized into batches of 50 demands at a time.
Suspension of Fees: AAA filing fees for all claims outside the active batch shall be suspended until the claim becomes part of an active batch.
Bellwether Process: The first batch shall proceed to arbitration to establish precedent. No other demands may be filed or processed until the first batch is resolved.
Mandatory Mediation: Prior to the arbitration of any subsequent batch, the parties shall engage in a global mediation to attempt to resolve the remaining claims.
Authority: A court of competent jurisdiction shall have the authority to enforce this batching protocol and enjoin the filing or prosecution of arbitration demands that violate it.

11. GENERAL PROVISIONS

Severability: If any provision of these Terms is held to be invalid or unenforceable (except for the Class Action Waiver), such provision shall be struck and the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with the incorporated Privacy Policy, constitute the entire agreement between the parties regarding the Site.
No Waiver: LHG’s failure to enforce any right or provision of these Terms will not be considered a waiver of such right.
