LIBERTY HOME GUARD PRIVACY POLICY

1. INTRODUCTION

Liberty Home Guard LLC and its affiliates (“LHG,” “we,” or “us”) respect your privacy. This Privacy Policy governs your use of libertyhomeguard.com (the “Site”) and our services. By accessing our Site, submitting a quote request, or using our services, you agree to this Policy. This Privacy Policy is incorporated into and subject to the Liberty Home Guard Terms of Use (available at https://www.libertyhomeguard.com/terms-of-use/). Your use of the Site and our services is governed by the Terms of Use, including all limitations of liability and dispute resolution provisions set forth therein.

2. INFORMATION WE COLLECT

We collect information to provide services, process claims, and manage vendor relationships.

  • Personal Information: Name, address, phone number, email, payment details (encrypted), and account credentials.
  • Technical Data: IP address, browser type, device ID, and geolocation.
  • Session Replay & Usage Data (CIPA Notice): We use third-party tools (such as Hotjar, FullStory, or Google Analytics) that may employ software code to record your interactions with the Site, including mouse movements, keystrokes, scrolling, and clicking. By using the Site, you expressly consent to this monitoring and recording for quality control and fraud prevention purposes.
  • Biometric Data: For technicians and vendors, we collect facial geometry data for identity verification (see Section 5).
  • Data Retention. We retain Personal Information only as long as necessary to fulfill the purposes outlined in this Policy, or as required by law (e.g., tax, legal, accounting). * Biometric Data: Retained max 3 years.
    • Call Recordings: Retained for up to 90 days for quality assurance.
    • Account Data: Retained for the duration of your account plus up to 7 years for statute of limitations purposes.
3. COMMUNICATIONS AND CONSENT TO CONTACT (TCPA & CAN-SPAM)

IMPORTANT: PLEASE READ CAREFULLY. By submitting your contact information to LHG (via web form, phone, or email), you expressly request and consent to receive communications from LHG and its partners, agents, and service providers.

  • Prior Express Written Consent: You agree that LHG may contact you via telephone calls, text messages (SMS/MMS), emails, and push notifications.
  • Automated Technology: You specifically consent to receive communications generated by an automatic telephone dialing system (ATDS), pre-recorded messages, artificial voice, and AI-generated voice technology.
  • Do Not Call Lists: You waive any rights under federal or state "Do Not Call" registries.
  • Condition of Purchase: Consent to receive automated marketing calls/texts is not a condition of purchasing any goods or services.
  • Recording: You agree that all calls to and from LHG may be monitored and recorded.
4. HOW WE USE AND SHARE INFORMATION

We do not sell your Personal Information for monetary consideration. However, we may share information as follows:

  • Service Providers: With contractors, claims adjusters, and repair professionals to fulfill your service requests.
  • Marketing Partners (CPRA Notice): To provide you with relevant offers. Under California law (CPRA) and other state laws, sharing data for cross-context behavioral advertising may be considered "selling" or "sharing." You may opt-out of this (see Section 6).
  • Legal Compliance: When required by law, subpoena, or to protect LHG’s rights and safety.
5. BIOMETRIC INFORMATION (TECHNICIANS & VENDORS)

Technicians agree to the collection of biometric identifiers (facial geometry) for identity verification.

  • Retention: Biometric data is permanently destroyed no later than the earlier of: (i) three (3) years after the last interaction; or (ii) 30 days after a valid deletion request, unless a longer period is required by law.
  • Incidental Capture: If you are a non-technician (e.g., a homeowner) and your image is incidentally captured during a technician's verification process, you release LHG from liability regarding such incidental collection.
6. YOUR PRIVACY RIGHTS & OPT-OUTS

6.1. Marketing Opt-Out.

  • Email: Click "Unsubscribe" in any email.
  • Text: Reply "STOP" to any SMS.
  • Phone: Ask the agent to remove you or contact compliance@libertyhomeguard.com.
  • Processing Time: We honor opt-out requests within a reasonable time, not to exceed ten (10) business days for calls/texts, or as required by applicable law.

6.2. State-Specific Rights (CA, CO, CT, UT, VA, TX, OR, MT).

Residents of these states have the right to:

  • Confirm if we process your data and access it.
  • Correct inaccuracies or request deletion.
  • Opt-out of "Sales" or "Sharing" of data for targeted advertising.

  • Right to Appeal: If we deny your privacy request, you have the right to appeal our decision by contacting compliance@libertyhomeguard.com. If you are unsatisfied with the outcome of an appeal, you may contact your state’s Attorney General.
  • Global Privacy Control (GPC): We recognize valid Global Privacy Control (GPC) signals enabled in your browser as a request to opt-out of the "sale" or "sharing" of your Personal Information.
7. DATA SECURITY

We use industry-standard encryption and safeguards. However, you acknowledge that no transmission over the Internet is 100% secure. You are responsible for keeping your account credentials confidential.

8. DISPUTE RESOLUTION: ARBITRATION & CLASS ACTION WAIVER

8.1. Mandatory Arbitration. Any dispute relating to this Policy or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in New York, NY.

8.2. Class Action Waiver. You waive any right to participate in a class action or representative proceeding.

8.3. Mass Arbitration Protocol. If 25 or more similar demands for arbitration are filed against LHG by the same or coordinated counsel ("Mass Filing"), they shall be resolved in staged batches of 50. Arbitrator filing fees for non-active batches shall be suspended until the batch is active. You agree to this process to ensure efficient resolution and minimize costs.

8.4. Jury Waiver. You strictly waive your right to a trial by jury.

9. THIRD-PARTY LINKS

Our Site may contain links to third-party websites (e.g., financing partners). We are not responsible for their privacy practices.

10. CHANGES TO THIS POLICY

We may update this Policy at any time. Your continued use of the Site after the Effective Date constitutes acceptance of the revised terms.
